Prosecution to commence over Jagersfontein tailings dam failure

The Department of Water and Sanitation (DWS), in collaboration with the Department of Forestry, Fisheries and the Environment (DFFE), have confirmed that criminal proceedings are set to commence following the 2022 tragic collapse of the Jagersfontein Fine Tailings Storage Facility (FTSF).

The collapse of the FTSF caused severe devastation to the town of Jagersfontein in the Free State, claiming two lives and leaving one person still unaccounted for.

The release of processed mine tailings, which are waste materials left over after valuable minerals are extracted during the mining process, resulted in extensive destruction to houses, roads, and other infrastructure, while large areas of natural and agricultural land, as well as surrounding watercourses, were covered in waste material.

In response, government agencies, specialist organisations, and civil society rallied to provide relief to affected community and its livestock.

A long-term rehabilitation programme, led by the DFFE with assistance from several state entities and expert organisations, has since been implemented.

In joint statement issued on Wednesday, the departments reported that damaged infrastructure, including houses and roads, has been repaired, and ongoing environmental clean-up and land restoration efforts are being funded by Jagersfontein Developments.

According to the departments, the DWS Dam Safety Regulation Directorate conducted an extensive technical study into the cause of the failure.

“This included site visits and expert evaluations by specialist civil engineers, i.e. geotechnical and hydraulic engineers from the University of Pretoria and the University of the Witwatersrand.

“Parallel to this, the Environmental Management Inspectorates from both DFFE and DWS conducted a joint investigation into the incident. A criminal case docket was finalised and referred to the National Prosecuting Authority (NPA) in Bloemfontein, which has taken the decision to prosecute,” the departments said.

The first court appearance is scheduled for 10 September 2025 at the Jagersfontein Magistrate’s Court. It is expected that the case will be transferred to a higher court the same day, paving the way for a full trial.

Treasury and SARS invite public comment on draft 2025 Taxation Laws Amendment Bill

National Treasury and the South African Revenue Service (SARS) have invited the public to comment on the 2025 draft Taxation Laws Amendment Bill (TLAB) and its accompanying Explanatory Memorandum, published on 16 August 2025. 

The proposed policy was published on 16 August 2025 for public comment and the closing date for  public comments is 12 September 2025.

“The 2025 draft TLAB proposes that the definition of a ‘hybrid equity instrument’ contained in section 8E of the Income Tax Act be refined. 

“The current approach relies on a set of anti-avoidance criteria and rules (that includes a three-year rule) to determine whether a preference share has debt-like features. If so, the preference dividend is deemed to be taxable income in the hands of the holder to ensure the correct tax treatment,” National Treasury said.

The proposal’s aim is to shift to a principle-based approach that classifies a financial instrument based on its substance rather than its legal form, as is the case in several other countries. 

For example, if a preference share is redeemable on a specific date and/or has a fixed mandatory dividend, it should be treated as a loan (debt) for tax purposes. 

“This ensures that financial instruments that are economically similar to debt are treated as such for tax purposes, thereby preventing the misuse of dividend exemptions to reduce tax liabilities.

“However, numerous commentators have raised concerns with National Treasury and SARS that the current broad wording in the draft TLAB in relation to this proposal will effectively eliminate preference shares as a viable means of financing. 

“Although the amendment is in draft form and could still be amended after further consultation, the uncertainty surrounding the proposal is impacting on current transactions, with a potential delay in investments,” National Treasury said.

To avoid a negative impact on current financing, the Minister of Finance, on the advice of National Treasury and SARS, has decided to retract the proposal in respect of the definition of a ‘hybrid equity instrument’ from the 2025 draft TLAB.

Any future proposals on structural changes to the taxation of hybrid equity instruments will follow a consultative process with all stakeholders to identify a balanced tax approach that takes into consideration the concerns of both stakeholders and government before draft tax legislation is published. – SAnews.gov.za

SANParks charts its goals with Vision 2040

The work of the South African National Parks (SANParks) is now recognised internationally as best practice for inclusive conservation, says Minister of Forestry, Fisheries and the Environment, Dr Dion George.

Through international collaboration, South Africa has strengthened partnerships with the United Nations Environment Programme, the Convention on Biological Diversity, the World Wildlife Fund, and the Global Environment Facility.

“These partnerships ensure that South Africa’s conservation strategies align with global climate and biodiversity commitments, while leveraging international funding, technical support, and knowledge exchange,” George said on Wednesday, in Gqeberha.

George was addressing the inaugural Vision 2040 Indaba on Wednesday, which is intended to foster meaningful dialogue and forge collaborative actions that will advance the implementation of Vision 2040. 

The gathering was hosted by SANParks and attended by stakeholders including government, farming communities, civil society, academia, the private sector, land claimant communities and youth representatives. Discussions centred on SANParks’ new Vision 2040 strategy, which aims to link biodiversity conservation with social justice and economic empowerment through community participation. 

The indaba is designed to drive collaborative actions to implement a people-centred approach to conservation. 

George said South Africa is also using the platform of the Group of Twenty (G20) to share its expertise on green finance and the biodiversity economy. 

South Africa assumed the G20 Presidency on 1 December 2024. The presidency, which runs until 30 November 2025, is themed: ‘Solidarity, Equality, Sustainability’.

“Countries around the world are keen to learn from our model, which links conservation with economic opportunities. From eco-tourism enterprises in remote rural areas to sustainable game meat initiatives that create jobs, South Africa proves that protecting nature can also grow the economy. These lessons are now influencing conservation strategies across Africa, Asia, and Latin America,” the Minister said.

“The G20 Presidency also highlights the role of South Africa as a thought leader in inclusive conservation. Delegations from Europe, Asia, the Americas, and Africa have visited our parks to observe anti-poaching strategies, community engagement initiatives, and ecological restoration programmes. 

“These exchanges foster learning, innovation and partnerships that benefit both our country and the international community. Through these global engagements, SANParks has shown that integrated conservation is not just a local necessity: it is a model with international relevance,” George said.

He emphasised that South Africa is demonstrating that protecting biodiversity, empowering communities, and building resilient ecosystems are strategies that benefit nations, economies and the planet. 

“South Africa is using the G20 platform to influence global policy, showcase practical solutions, and inspire other nations to adopt people-centred, sustainable and innovative conservation practices.

“The G20 Presidency has also allowed us to highlight the link between conservation and sustainable development. By combining protected area management with inclusive economic growth, we are showing the world that ecological protection is not a luxury. 

“It is a necessity for prosperity, social equity, and long-term resilience. SANParks is demonstrating that conservation is both a moral imperative and a practical investment in the future of our people and our planet.

“In short, the G20 Presidency has allowed South Africa to step onto the world stage as a symbol of integrated conservation. It is an opportunity to celebrate our achievements, anchor our vision in a global context, and demonstrate that the future of conservation is interconnected, inclusive, and internationally recognised,” the Minister said.

Twelve months ago, SANParks unveiled Vision 2040, a strategy that marks a decisive shift in how South Africa sees conservation and the role of protected areas in society. 

“Vision 2040 is not simply about preserving land or counting species. It is about integrated conservation. It is a deliberate, holistic approach that links ecological integrity, climate resilience, and human well-being.

“It is about reimagining landscapes as Mega Living Landscapes, where protected areas, agricultural land, communal spaces, and private holdings come together in a network that supports biodiversity, sustainable livelihoods, and cultural heritage,” the Minister said.

These Mega Living Landscapes are a powerful departure from traditional conservation models. 

“They embody intentionality, co-creation, social justice, inclusivity, and equitable access. They remind us that the environment and people are not separate. They are inextricably connected. 

“The well-being of one depends on the thriving of the other. As South Africa positions itself as a leader in sustainable development and environmental stewardship, SANParks is at the forefront,” the Minister said.

This year, Vision 2040 has been implemented through addressing the urgent threat of rhino poaching, fighting illicit wildlife crime, protecting life and livelihoods, elevating three of South Africa’s national icons into global leaders in conservation, ecological protection, and inclusive tourism and promoting SANParks at the G20. – SAnews.gov.za

Suspect to appear in court over stock theft

The formation of the Stock Theft Prevention Task Team is bearing fruit with a 40-year-old suspect due to appear before the Mthatha Magistrate Court on suspected stolen stock charges, the South African Police Service (SAPS) said.

The arrest comes in the second month of the formation of the Stock Theft Prevention Task Team in the OR Tambo District to prevent stock theft in hotspot areas within the district.

The team recovered stolen sheep in Mthatha and Bityi on Wednesday and the early hours of Thursday.

The suspect was arrested on Wednesday with one live sheep and a carcass which were allegedly stolen at the Mthatha SPCA, with the employees positively identifying them.

In another unrelated incident in Xhwili – Bhityi, 53 sheep were recovered by the task team and were returned to the lawful owner. The police said the sheep were stolen on Wednesday night and then abandoned.

The police urged stock farmers to visit their kraals and immediately report stolen stock for quick police assistance.

“The arrested 40-year-old man is due to appear before Mthatha Magistrate Court on Thursday, 04 September 2025 for possession of suspected stolen stock,” the police said.

The OR Tambo District Commissioner, Major General Norman Modishana, commended the swift actions by the team in fighting stock theft in the district as it remains one of the stubborn crimes to be harshly dealt with. – SAnews.gov.za

Nasi Ispani 2.0 to provide 45 000 job and training opportunities

A new wave of 45 000 job and training opportunities is coming to Gauteng as the provincial government prepares to launch the second round of the Nasi Ispani programme this Saturday.

The initiative, described as a “transformative” tool to combat unemployment, develop skills and deter crime while building state capacity, specifically targets youth not in employment, education, or training (NEET).

“In this year’s State of the Province Address, the Gauteng government reaffirmed its commitment to tackling unemployment as a primary focus. As a key part of this effort, the Nasi Ispani initiative will be relaunched on September 6.

“Originally launched in June 2023, Nasi Ispani has already generated substantial employment through its 13 Special Programmes. This next phase, Nasi Ispani 2.0, aims to create 45 000 new job opportunities. It will specifically target youth who are not in employment, education, or training [NEET]” Premier Panayza Lesufi said during a media briefing on Wednesday.

The training and work opportunities will include internships, work-integrated learning, artisanal development in mining communities, the Presidential Youth Employment Initiative and the filling of vacancies.

“The initiative will also continue programmes from the previous intake, such as the Aga Lerona Road Workers, the Sawubona Mhlali Brigade, and internships,” the Premier added.

The second round of Nasi Ispani will focus on the Unemployed Youth Skills Development Initiative (UYSDI) which is expected to enrol some 2810 participants in training opportunities including:
•    Domestic and municipal plumbing
•    Basic electrical installation and maintenance
•    Construction and plastering
•    Electronics repair
•    Painting and surface furnishing
•    Tiling and floor finishing
•    Landscaping and horticultural maintenance
•    Woodworking and furniture repairs
•    Basic automotive servicing and repairs

The Gauteng City Region Academy will also offer the following training opportunities:
•    Solar photovoltaic system mounter
•    Bricklayer’s assistant
•    Carpentry
•    Plumbing assistant
•    ICT Learnerships and training
•    Skills development in mining communities
•    Paving machine operator
•    Welding

“Nasi Ispani is not a panacea or a magic wand that will solve the problem of unemployment.

“However, its core objective is to build a capable state by hiring residents directly for public service roles, thereby reducing the province’s dependence on external service providers. It also aims to skill the youth to ensure they are in a better position to get jobs in the public or private sectors or to become entrepreneurs or self-employed,” Lesufi said. – SAnews.gov.za

Police rescue kidnapped businessman

The South African Police Service (SAPS) Anti-kidnapping Task Team has safely reunited a businessman with his family following a shootout with the alleged mastermind behind the kidnapping. 

The businessman was found in Alexandra in a shack shortly after midnight on Thursday.

His rescue follows a shooting in which the alleged mastermind behind the kidnapping was shot and killed during a confrontation with police officers near the R21 in Kempton Park, on Wednesday evening. 

“The suspect, who goes by the nickname, Dollarman, is a wanted kidnapping kingpin in both SA and Mozambique. He is on SERNIC, which is Mozambique’s wanted persons database, where he was wanted for several kidnappings for ransom cases,” the South African Police Service said in a statement. 

In South Africa, he was also linked to at least five kidnappings for ransom cases, as well as other cases of housebreaking, carjacking and possession of unlicensed firearms. 

“From July 2021 to date, more than 337 kidnappers have been arrested by the SAPS Anti-Kidnapping Task Team, and more than 146 illegal firearms were seized in all these crime scenes,” the police said. 

In the past week alone, police have arrested more than 14 773 suspects for various crimes ranging from murder to rape, and at least 163 illegal firearms have been seized during Operation Shanela. – SAnews.gov.za

Deputy President Mashatile meets representatives of the Griqua Royal House

In his capacity as Chairperson of the Presidential Task Team on Matters raised by Traditional and Khoi-San Leaders, Deputy President Shipokosa Paulus Mashatile has this morning, 02 September 2025, met with Representatives of the Griqua Royal House at OR Tambo Official Residence in Pretoria.

In June this year, the Office of the Deputy President received a letter from The Griqua Royal House requesting a meeting with the Deputy President to discuss the Traditional Leadership recognition of the Khoi and San communities, among other things.

Today’s meeting provided an opportunity for Deputy President Mashatile to brief the Representatives of the Griqua Royal House on progress on the process of the recognition of the Khoi and San communities by the Commission on Khoi-San Matters.

The Commission on Khoi-San Matters (Commission) is a statutory body established in terms of section 51(1) of the Traditional and Khoi-San Leadership Act of 2019.

In terms of section 57 and 58 of the Act, the Commission has the following functions:
• To receive applications for the recognition of Khoi-San communities, branches, senior Khoi-San leaders and Branch Heads.
• To investigate the applications received.
• To prepare comprehensive reports with recommendations on each application that has been received and investigated.
• To submit the report and the recommendations of each received and investigated application to the relevant Premier for comment and give the Premiers a period of 60 days to provide the comments.
• After receiving the comments from the relevant Premiers, the Commission must finalise and submit its report containing its recommendations to the Minister on the possible recognition of Khoi-San communities, branches, and leaders.

In this regard, Mr Cordney Mangale led the presentation by the Representatives of the Griqua Royal House after which the meeting was assured that all processes for recognition are being followed accordingly and that the Commission would make an announcement on the outcome of the application for recognition before the end of its term in August 2026.

Deputy President Mashatile thanked the Commissioners and  Representatives of the Griqua Royal House for attending to the matters raised in the most cordial fashion and for their commitment to promoting and preserving institutions of Traditional and Khoi-San Leadership in South Africa.

The meeting was also attended by Deputy Minister of Cooperative Governance and Traditional Affairs, Prince Zolile Burns-Ncamashe and Senior Government Officials.

NYDA and NSFAS forge strategic partnership to empower SA’s youth

The National Youth Development Agency (NYDA) has forged a new strategic partnership with the National Student Financial Aid Scheme (NSFAS) to combine resources and redirect young people toward opportunities in institutions of higher learning.

The collaboration, formalised through a Memorandum of Understanding (MOU), marks a significant commitment to expanding educational and development opportunities for young people across South Africa, with a dedicated focus on those in rural areas, townships, and informal settlements.

NYDA Executive Chairperson, Dr Sunshine Myende, said the partnership is a direct response to the critical skills gap and persistent inequality that hinder youth advancement.

“Data from the NYDA’s Jobs Programme highlight that the majority of young people reside in rural areas and many do not possess a matric qualification. In response, the NYDA has initiated this partnership with NSFAS to align efforts, combine resources, and redirect young people toward opportunities in institutions of higher learning,” Myende said.

Key pillars of the collaboration

The agreement establishes a framework for action built on several key pillars:
•    Decentralised access: To bring services closer to young people, NSFAS will leverage the NYDA’s national footprint. NYDA offices, particularly those in rural, township, and informal settlement areas, will serve as walk-in support centres for NSFAS applications, ensuring vital funding services are accessible to all.
•    Bridging the digital divide: Recognising that connectivity should not be a barrier to education, the NYDA and NSFAS are exploring partnerships with telecommunications providers. This initiative aims to ensure reliable online application processes, even in the most remote locations.
•    Expanding educational pathways: To address the current imbalance in applications, the partnership will actively promote greater awareness and support for funding opportunities at Technical and Vocational Education and Training (TVET) institutions, creating a more diverse and skilled future workforce.
•    Solving student accommodation: The organisations will collaborate on developing sustainable, innovative solutions to the student accommodation crisis, with the NYDA contributing directly to ongoing policy development in this critical area.

Myende highlighted that the partnership reflects the current NYDA Board’s unwavering focus on inclusivity and equitable access to essential youth services.

By working closely with NSFAS, he said the agency aims to ensure that financial aid, development support, and educational access extend beyond urban centres, and “reaches every young person, no matter where they live.”

“This partnership marks a pivotal moment in building a more inclusive and prosperous future for all South African youth. This MOU is more than a formal agreement; it is a commitment to ensuring that no young person is left behind, regardless of their location.

“Through this collaboration, we are opening doors not just to funding, but to opportunity, development, and ultimately dignity,” Myende said.
